Art. 1 - General provisions
1. By navigating in this area, the user accesses FIORIRE, accessible via the url:
https://www.nomesito.com . Browsing and placing a purchase order on the site imply acceptance of the Conditions and Data Protection Policies adopted by the site itself indicated therein.
2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by:

3. Before accessing the products provided by the site, the user is required to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
4. The user is invited to download and print a copy of the purchase form and of these General Conditions of Sale, the terms of which FIORIRE reserves the right to modify unilaterally and without prior notice.
Art. 2 - Object
1. These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on FIORIRE and do not govern, however, the supply of services or the sale of products by parties other than the seller who are present on the same site via links, banners or other hypertext connections.
2. Before placing orders and purchasing products and services from different parties, we suggest you check their
conditions of sale.
Art. 8 - Delivery
1.FIORIRE ships throughout Italy, excluding the Vatican City and the Republic of San Marino.
2. FIORIRE will only deliver to the user's home address, provided at the time of purchase.
3. Delivery is made on the current day of online purchase, provided that the order is placed before 12:00 excluding Sunday and Monday (days on which no deliveries will be made except for any specific requests assessed together with the customer).
4. Delivery time may be extended in case of:
- the order falls within a delivery area outside the reach of the nearest associated florist;
- for special occasions (e.g. Valentine's Day, Women's Day or similar special holidays);
- the address/telephone number entered was incorrect or incomplete;
- there is no one at the recipient's address and the courier deems it inappropriate to leave the flowers in unsafe areas
5. If delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that you intend to terminate the contract.
6. As a result of the resolution, the amounts will be returned, including delivery costs with the exclusion of any additional costs resulting from the choice of a delivery method other than the ordinary method offered without unjustified delay and, in any case, within 14 days from the date of resolution of the contract. Transport resulting from the resolution of the contract may have additional costs that will be borne by the buyer.
7. Shipping costs are the responsibility of the buyer and are explicitly highlighted when placing the order (the fixed cost for each shipment is €10 - this could increase only if the delivery address is too far from the nearest associated florist or if it is necessary to make a second delivery attempt).
8. Once the order has been placed, it will be the buyer/sender's responsibility to ensure that the details provided are correct (Name and Surname of the recipient, destination address, telephone number and email).
Art. 9 - Right of withdrawal
1. The right of withdrawal applies only to products referred to in Legislative Decree no. 206 of 6 September 2005 (Consumer Code).
2. Order changes will be accepted only if the associated florist to whom the delivery has been entrusted has not already proceeded with the organization of the same. For cancellation requests, please notify within 24 hours of the order. Cancellation requests beyond this period will not be honored. Within the deadline indicated above, the customer must give notice of his intention to withdraw from the contract by sending an email to progettofiorirefio@gmail.com or by calling the number +39 391 132 8857. The product must be returned to the address communicated by email. Orders with delivery already organized or already in delivery cannot be cancelled.
3. As regards the terms, methods of returning the goods, costs and all other aspects, the provisions of the aforementioned Legislative Decree no. 206/2005 apply. 9.3. It is recalled that pursuant to Legislative Decree no. 206/2005.
Art. 10 - Comunicazioni
1. Except in cases expressly mentioned or those established by law, communications between the seller and the buyer will preferably take place via email messages sent to their respective email addresses, which will be considered by both contracting parties as a valid means of communication and whose use cannot be challenged in court for the sole fact of being electronic documents.
2. Either Party may change its email address for the purposes of this Article at any time, provided that it promptly notifies the other Party in accordance with the forms referred to in the preceding paragraph.
Art. 11 - Withdrawal
1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the deadlines mentioned in the RIGHT OF WITHDRAWAL section.
2. The user who intends to exercise the right of withdrawal from the purchase may send an email, indicating the order number and the user's name, to: progettofiorirefio@gmail.com
3. The buyer must also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014, which is not mandatory. Since we are dealing with fresh products, subject to natural deterioration, we invite you to contact us as soon as possible if the product presents any type of problem. Fiorire reserves the right to evaluate the condition of the product and determine its suitability for a refund or replacement. As an alternative to a refund, a gift or discount voucher may be offered to compensate for any inconvenience caused.
4. The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum of 14 days, including any shipping costs incurred by the user. Fiorire cannot give you the right to a refund if the product has not been delivered due to uncontrollable circumstances, for example when the recipient refuses the flowers. In such cases, Fiorire does not consider itself responsible, furthermore it will require additional costs for a request to change the delivery address and will have full discretion whether an alternative address will be approved or refused.
5. Fiorire, in the event of any problems at our expense, will provide a refund or organize a new delivery attempt but does not assume any responsibility and reserves the right to refuse a refund for a case of non-delivery caused by incorrect delivery information or unavailability of the recipient.
6. As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods or until the buyer has demonstrated that he has returned the goods.
7. The right of withdrawal will not apply in the event that the services and products of FIORIRE are included in the categories of art. 59 of Legislative Decree 206/2005.
8. The site will refund using the same payment method chosen by the buyer during the purchase. In the case of payment made by bank transfer, and if the user intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary for the refund.
9. If your order, despite the delivery confirmation, is not delivered, we recommend that you contact us as soon as possible to verify the situation.

Art. 15 - Applicable law and competent court
1. These General Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the purchaser. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law.
2. Any disputes inherent and/or consequent to the same shall be resolved exclusively by the Italian judicial authority. In particular, if the user is a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same in accordance with the applicable law.
