Art. 1 - Disposizioni generali

1. By navigating in this area, the user accesses FIORIRE, accessible via the url:

https://www.nomesito.com . Browsing and placing a purchase order on the site imply acceptance of the Conditions and Data Protection Policies adopted by the site itself indicated therein.

2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by:

3. Before accessing the products provided by the site, the user is required to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.

4. The user is invited to download and print a copy of the purchase form and of these General Conditions of Sale, the terms of which FIORIRE reserves the right to modify unilaterally and without prior notice.

Art. 2 - Object

1. These General Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on FIORIRE and do not govern, however, the supply of services or the sale of products by parties other than the seller who are present on the same site via links, banners or other hypertext connections.

2. Before placing orders and purchasing products and services from different parties, we suggest you check their

conditions of sale.

Art. 3 - Conclusion of the contract

1. To conclude the purchase contract, it will be necessary to fill out the form in electronic format and transmit it following the relevant instructions.

2. It contains a reference to the General Conditions of Sale, images of each product and its price, the payment methods that can be used, the delivery methods of the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; methods and times for returning the purchased products.

3. Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale including the Information on the right of withdrawal and the processing of personal data.

4. The contract is concluded when the seller receives the form filled out by the user, after verifying the correctness of the data contained therein.

5. The user will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will happen by clicking on the "Buy" button at the end of the wizard.

6. Once the contract has been concluded, the seller takes charge of the order for its fulfillment.

Art. 4 - Registered users

1. In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide his/her personal data correctly and truthfully.

2. The confirmation will in any case exonerate FIORIRE from any responsibility regarding the data provided by the user. The user undertakes to promptly inform FIORIRE of any variation of his/her data communicated at any time.

3. If the user communicates inaccurate or incomplete data or even in the event of a dispute by the interested parties regarding the payments made, FIORIRE will have the right to not activate or suspend the service until the relevant deficiencies are rectified.

4. Upon the first request for activation of a profile by the user, FIORIRE will assign the same username and password. The latter recognizes that these identifiers constitute the validation system of the user's access to the Services and the only system suitable for identifying the user that the actions performed through such access will be attributed to him and will have binding effect on him.

5. The user undertakes to maintain the confidentiality of his/her access data and to safeguard them with due care and diligence and not to transfer them, even temporarily, to third parties.

Art. 5 - Product availability

1. Product availability refers to actual availability at the time the user places the order. However, this availability must be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products could be sold to other customers before the order is confirmed.

2. Even after sending the order confirmation email, there may be cases of partial or total unavailability of the flowers, so sometimes the flowers of the chosen bouquet and the selected plants may not be available. In these cases, our local florists will be authorized to automatically proceed with the replacement of the products with other similar ones of equal or greater value than those indicated in the original product. Other times the replacement may only concern the color of the flower which in this case will also be replaced with a similar color. FIORIRE tends to specify that the image representing each individual product is purely indicative and may not fully reflect the characteristics of the article.

3. If the user requests the cancellation of the order, terminating the contract, FIORIRE will refund the amount paid within 14 days from the moment in which FIORIRE has become aware of the buyer's decision to terminate the contract.

Art. 7 - Payment methods and prices

1. The price of the products will be that indicated from time to time on the site, except where there is an obvious error.

2. In the event of an error, FIORIRE will notify the buyer as soon as possible, allowing confirmation of the order at the correct amount or cancellation. In any case, FIORIRE will not be obliged to supply the item sold at the lower price erroneously indicated.

3. The prices on the site include VAT and shipping costs. | prices may change at any time. | changes do not affect orders for which an order confirmation has already been sent.

4. Once you have selected the desired products, they will be added to the cart. Simply follow the instructions for purchasing, entering or verifying the information requested at each step of the process. The order details can be modified before payment.

Art. 8 - Delivery

1.FIORIRE effettua spedizioni in tutto il territorio italiano, escluse lo stato di Città del Vaticano e la Repubblica di San Marino.

2. FIORIRE effettuerà solamente consegne presso il domicilio fornito al momento dell'acquisto.

3. La consegna viene effettuata nella giornata corrente dell'acquisto online, purché l'ordine sia avvenuto entro le 12:00 escludendo la Domenica e il Lunedì (giorni in cui non saranno effettuate consegne eccetto eventuali e specifiche richieste valutate insieme al cliente).

4. Il tempo di consegna potrebbe prolungarsi nel caso in cui:

- l'ordine rientrasse in un'area di consegna fuori dalla portata del primo fiorista associato più vicino;

- per occasioni speciali (es. San Valentino, festa della donna o feste particolari simili);

- l'indirizzo/il numero di telefono inseriti fossero errati o incompleti;

- non ci fosse nessuno all'indirizzo del destinatario e il corriere ritiene inopportuno lasciare i fiori in aree poco sicure

5. Qualora la consegna non possa avere luogo per cause a noi non imputabili, dopo dieci giorni massimo dalla data in cui l'ordine è disponibile per la consegna, assumeremo che si intenda risolvere il contratto.

6. Le spese di spedizione sono a carico dell'acquirente e sono evidenziate esplicitamente al momento dell'effettuazione dell'ordine (il costo fisso per ogni spedizione è pari a 10€ - questa potrebbe aumentare solo nel caso in cui l'indirizzo di consegna fosse troppo distante dal primo fiorista associato più vicino o qualora fosse necessario effettuare un secondo tentativo di consegna).

7. Una volta effettuato l'ordine sarà premura dell'acquirente/mittente assicurarsi che i dettagli forniti siano corretti (Nome e Cognome del destinatario, indirizzo di destinazione, numero di telefono e email).

Art. 9 - Right of withdrawal

1. The right of withdrawal applies only to products referred to in Legislative Decree no. 206 of 6 September 2005 (Consumer Code).

2. Order changes will be accepted only if the associated florist to whom the delivery has been entrusted has not already proceeded with the organization of the same. For cancellation requests, please notify within 24 hours of the order. Cancellation requests beyond this period will not be honored. Within the deadline indicated above, the customer must give notice of his intention to withdraw from the contract by sending an email to progettofiorirefio@gmail.com or by calling the number +39 391 132 8857. The product must be returned to the address communicated by email. Orders with delivery already organized or already in delivery cannot be cancelled.

3. As regards the terms, methods of returning the goods, costs and all other aspects, the provisions of the aforementioned Legislative Decree no. 206/2005 apply. 9.3. It is recalled that pursuant to Legislative Decree no. 206/2005.

Art. 10 - Communications

1. Except in cases expressly mentioned or those established by law, communications between the seller and the buyer will preferably take place via email messages sent to their respective email addresses, which will be considered by both contracting parties as a valid means of communication and whose use cannot be challenged in court for the sole fact of being electronic documents.

2. Either Party may change its email address for the purposes of this Article at any time, provided that it promptly notifies the other Party in accordance with the forms referred to in the preceding paragraph.

Art. 11 - Withdrawal

1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the deadlines mentioned in the RIGHT OF WITHDRAWAL section.

2. The user who intends to exercise the right of withdrawal from the purchase may send an email, indicating the order number and the user's name, to: progettofiorirefio@gmail.com

3. The buyer must also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014, which is not mandatory. Since we are dealing with fresh products, subject to natural deterioration, we invite you to contact us as soon as possible if the product presents any type of problem. Fiorire reserves the right to evaluate the condition of the product and determine its suitability for a refund or replacement. As an alternative to a refund, a gift or discount voucher may be offered to compensate for any inconvenience caused.

4. The goods must be returned intact, in the original packaging, complete in all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum of 14 days, including any shipping costs incurred by the user. Fiorire cannot give you the right to a refund if the product has not been delivered due to uncontrollable circumstances, for example when the recipient refuses the flowers. In such cases, Fiorire does not consider itself responsible, furthermore it will require additional costs for a request to change the delivery address and will have full discretion whether an alternative address will be approved or refused.

5. Fiorire, in the event of any problems at our expense, will provide a refund or organize a new delivery attempt but does not assume any responsibility and reserves the right to refuse a refund for a case of non-delivery caused by incorrect delivery information or unavailability of the recipient.

6. As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the refund until receipt of the goods or until the buyer has demonstrated that he has returned the goods.

7. The right of withdrawal will not apply in the event that the services and products of FIORIRE are included in the categories of art. 59 of Legislative Decree 206/2005.

8. The site will refund using the same payment method chosen by the buyer during the purchase. In the case of payment made by bank transfer, and if the user intends to exercise his right of withdrawal, he must provide the bank details: IBAN, SWIFT and BIC necessary for the refund.

9. If your order, despite the delivery confirmation, is not delivered, we recommend that you contact us as soon as possible to verify the situation.

Art. 12 - Data processing

1. the buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy).

Art. 13 - Safeguard clause

1. In the event that one of the clauses of these General Conditions of Sale is void for any reason whatsoever, this shall in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

Art. 15 - Applicable law and competent court

1. These General Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the purchaser. Consequently, the interpretation, execution and resolution of the General Conditions of Sale are subject exclusively to Italian law.

2. Any disputes inherent and/or consequent to the same shall be resolved exclusively by the Italian judicial authority. In particular, if the user is a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same in accordance with the applicable law.
